Suite Nectar Salons Terms of Service

These Terms of Service (“Terms”) govern your use of the websites, forms, communications, and services offered by Suite Nectar LLC, doing business as Suite Nectar Salons (“Suite Nectar,” “we,” “us,” or “our”), including (without limitation) suite leasing inquiries, tours, customer communications, community amenities, and our SMS/text messaging program.

By accessing our website, submitting a form, scheduling a tour, opting into text messages, or otherwise interacting with Suite Nectar, you agree to these Terms. If you do not agree, do not use our services.

1) Who We Are

Suite Nectar Salons is a salon suite business that may offer:

  • Suite rental/leasing opportunities for independent beauty and wellness professionals (“Professionals”)
  • Common-area amenities and building services to support suite operations
  • Customer communications related to tours, leasing, and general inquiries
  • Optional marketing communications (with your consent)

2) Eligibility (18+)

You must be 18 years of age or older to use our services and participate in our SMS program. By using our services, you represent that you are at least 18.

3) Suite Leasing and Facility Use

Suite Nectar may provide information, tours, applications, and (where offered) suite rental agreements for Professionals.

Important: Any actual suite rental/lease is governed by a separate written agreement between you and Suite Nectar (the “Suite Agreement”). If these Terms conflict with the Suite Agreement, the Suite Agreement controls for suite rental matters.

You agree that you will:

  • Use the premises and common areas lawfully and in a manner consistent with a professional salon suite environment
  • Follow reasonable building rules (including access, security, noise, parking, sanitation expectations, and common-area conduct)
  • Not interfere with other Professionals, guests, vendors, or building operations

We may refuse service, end a tour, or restrict access if conduct is unsafe, disruptive, or unlawful.

4) Professional Licensing and Regulatory Compliance (North Carolina / Charlotte Area)

Professionals operating within salon suites are responsible for complying with all applicable federal, state, and local laws, regulations, and professional requirements, including licensing and sanitation requirements where applicable.

North Carolina’s cosmetology regulatory framework includes licensing requirements for cosmetic arts professionals, and the state board indicates that services provided in licensed cosmetic art shops must be performed by appropriately licensed individuals and that practice without a license may result in civil penalties. 

Suite Nectar does not provide legal, tax, or regulatory advice. If you have questions about your licensing status or compliance obligations, you should consult the appropriate licensing authority and/or your legal advisor.

5) Independent Business Status; No Employment Relationship

Unless explicitly stated in writing, Professionals who lease or occupy suites are generally operating their own independent businesses. Suite Nectar does not control the day-to-day services you provide to your clients, your pricing, your hours (except as building access rules may require), your booking systems, or your professional methods.

Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and Suite Nectar.

6) Applications, Forms, and Communications

If you submit an inquiry, application, or form, you agree that the information you provide is accurate and that you have the right to provide it. We may contact you using the information you provide (including phone/email) regarding your inquiry, tour scheduling, application status, and related communications.

7) Payments, Fees, and Third-Party Services

Website or tour inquiries generally do not require payment. Suite rental, deposits, fees, and any paid services (if offered) will be governed by the applicable Suite Agreement and/or written terms presented at the time of purchase.

If our website links to third-party services (e.g., scheduling tools, payment processors, maps), your use of those services is subject to the third party’s terms. We are not responsible for third-party services.

8) Marketing Consent and Preferences

Where legally required, we will obtain consent before sending marketing emails or promotional texts. You can opt out of marketing messages at any time as described in the relevant communication (see SMS opt-out below).

9) SMS/Text Messaging Terms (Program Rules)

This section applies if you opt in to receive text messages from Suite Nectar Salons (the “SMS Program”).

9.1 Description of SMS Program and Use Cases

If you opt in, Suite Nectar may send SMS messages for purposes that include:

  • Tour and leasing communications: tour confirmations/reminders, application updates, next steps, and scheduling
  • Customer support: responding to questions and providing requested information
  • Operational updates: access instructions for a scheduled visit, location updates, or important service notices
  • Promotions and marketing (if you opt in to marketing): special offers, events, announcements, and availability updates

Message frequency varies based on your interactions with us and the preferences you select.

9.2 Opt-Out Instructions

You can opt out at any time by replying STOP to any message you receive from us. After you reply STOP, you may receive one additional message confirming your opt-out.

10) Intellectual Property

All website content, logos, trademarks, text, images, and design elements are owned by or licensed to Suite Nectar and may not be copied, reproduced, or used without our written permission, except as permitted by law.

11) Disclaimers

Our website and general information are provided for informational purposes and may not reflect the most current availability, pricing, or suite features. We do not guarantee uninterrupted or error-free website operation.

To the fullest extent permitted by law, Suite Nectar disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12) Limitation of Liability

To the fullest extent permitted by law, Suite Nectar will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits or revenues, arising out of or related to your use of our services or SMS Program.

Where liability cannot be fully disclaimed, our total liability will be limited to the amount you paid us in the prior 3 months for the specific service at issue (or $100 if no payment was made), unless a different limitation is required by law.

13) Indemnification

You agree to indemnify and hold harmless Suite Nectar from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your unlawful conduct, or your misuse of our services.

14) Changes to These Terms

We may update these Terms from time to time. We will update the “Effective Date” when changes are posted. Continued use after changes become effective constitutes acceptance of the updated Terms.

15) Governing Law and Venue (North Carolina)

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Any legal action arising from these Terms must be brought in a court of competent jurisdiction in Mecklenburg County, North Carolina, unless applicable law requires otherwise.
